How long will my claim take?
This depends on the type of work injuries you´ve suffered and whether or not your employer´s Insurer fights your claim. If your claim and injuries are minor/moderate and someone accepts responsibility for your accident straightaway you could get your compensation within 6-9 months. If your injuries are more serious, a settlement may take much longer. This is because, before you settle your claim, you need to be sure you have either fully recovered or know how your injuries will affect you in the future so that we can claim for everything you've suffered.
Most claims are settled within 12-18 months.
What happens next?
We will investigate your claim and discuss the full details of your work accident with you. We can do this over the phone; visit you at home or in hospital. We will then write a letter to your employer´s Insurer claiming for compensation. The Insurer has three months to investigate the claim at which point they must decide whether or not they are going to deny liability. If they do fight the claim, we will advise you whether to go to court. This will be discussed with you and together we will decide if your worker compensation claim is going to win in the Courts. The insurer may decide not to fight the claim and if you have recovered, we will start negotiations with them to settle your claim immediately. If you have not fully recovered from your work injury we will wait until your condition has improved so that everything can be taken into account in your claim. What Are General and Special Damages?
The amount of compensation you will receive if the claim succeeds is made up of two parts.
"General Damages" - this is the term given to the pain and suffering element. The value of this part of your claim depends on the type of injury you have suffered, how long you were suffering from your injury, and whether your injury is going to have a long term effect on your life. A figure is set for this part based on previous amounts set by judges in similar cases to yours, for example -

Broken Wrist - £3,000
Sprained Ankle - £2,000
"Special Damages" - this is the term given to your out of pocket expenses incurred as a result of the accident. This may include loss of earnings, loss of vehicle excess, hire of a replacement car, cost of public transport, prescriptions, etc.
This amount is added to the value of your general damages to make up the overall damages award.
